Family Sponsorship Green Card Categories

U.S. immigration laws apply very specific definitions to family relationships, and create categories (and preferences) based on these definitions. 

There are an unlimited number of green cards available for immediate relatives of U.S. citizens, defined as:

  • Spouses of U.S. citizens
  • Children (unmarried and under 21) of U.S. citizens
  • Parents of U.S. citizens who are 21 or older

For all other family members, USCIS applies preference categories with annual caps allotted to each category based on the priority date:

  • First Preference: Unmarried, adult (21 years+) sons and daughters of U.S. citizens
  • Second Preference (2A): Spouses of Green Card holders, unmarried children (under 21) of permanent residents
  • Second Preference (2B): Unmarried adult sons and daughters of permanent residents
  • Third Preference: Married sons and daughters (any age) of U.S. citizens
  • Fourth Preference: Brothers and sisters of adult U.S. citizens

If you are an immediate relative, the wait time for a green card may be relatively quick. If you fall within the preference categories, the wait time for a green card may be lengthy. The priority date is determined by the date the Form I-130 is filed, so it’s important to initiate the process quickly in order to get in the queue.

Step 1 

Schedule a Strategy Session

This will allow us to get to know each other and figure out if we are a good fit. If you decide to move forward within 30 days of your consultation, the consultation becomes free.

Step 2 

After you agree that we are a good fit, it is time to come up with a tailored  plan and execute. We will go over strategy and a roadmap of how to gather the best evidence, what affidavits are required, and how to put together flawless forms.

Step 3 

Amazing—now that we are almost there, we will put your entire application through an  error-proofing review system and discuss how it can be made even better. No cutting corners here.
