Do I actually qualify for citizenship by descent?

Under Section 3(1)(b) of the Canadian Citizenship Act, you may be a citizen by descent if you were born outside Canada and at least one of your parents was a Canadian citizen at the time of your birth. However, the first-generation limit (introduced in 2009) means that citizenship by descent does not automatically pass beyond the first generation born outside Canada. A strategy session with one of our lawyers is the fastest way to get a clear answer for your specific situation.

I was born abroad to a Canadian parent who was also born abroad. Do I qualify?

This is one of the most common questions we receive. Under the first-generation limit, citizenship by descent generally does not pass to a second generation born outside Canada. There are exceptions (for example, if the Canadian parent was born abroad while a parent of theirs was serving in the Canadian Armed Forces or as a Canadian government employee abroad), but these must be carefully evaluated case by case. We will assess your exact family history before making any representations about eligibility.

What documents do I need?

The specific documents required depend on your circumstances, but generally include your own birth certificate, evidence of your parent’s Canadian citizenship at the time of your birth, your parent’s birth certificate, and potentially additional supporting materials depending on how your parent acquired their citizenship. We will give you a customized checklist based on your exact situation so nothing is missed.

How long does IRCC take to process a citizenship by descent application?

Processing times vary and have historically ranged from several months to well over a year. We will give you realistic expectations based on current IRCC timelines at the time of your application and keep you informed throughout the wait.

What if some of my documents are in another language?

Documents not in English or French must be accompanied by a certified translation. We will let you know exactly which documents require translation and how to obtain one that meets IRCC’s standards.

What if I tried to apply on my own and my application was returned by IRCC?

Sometimes we are able to help with this. It depends on the specific reason for the return and the current state of the file. Our full-service clients take priority and our schedule does not always allow us to take on file-rescue cases. You are welcome to reach out, and we will give you more details. Please note that the fee to address a returned application is typically the same as the full-service fee, because it often requires just as much time to correct errors and rebuild the file.

Do you offer refunds?
